Dump It KC Junk Removal Service Agreement & Liability Waiver

1. Services

We provide junk removal using our dump trailer (rated capacity: 6 tons / 12,000 lbs). Base pricing includes up to 1,000 lbs. We may take timestamped photos/videos before, during, and after for records, insurance, and marketing (you grant irrevocable permission).

2. Trailer Damage & Loading Responsibility

TRAILER DAMAGE POLICY – YOU ARE RESPONSIBLE

Our dump trailer is Company property. You (and any helpers, family, friends, contractors, or machinery operators on your behalf) are solely responsible for damage from:

• Dragging sharp, jagged, abrasive, or heavy items
• Leaking fluids, chemicals, paint, grease, corrosives
• Uneven loading, overloading, or exceeding 6-ton capacity
• Use of machinery (skid steers, loaders, forklifts, etc.)
• Any negligent or improper loading

YOU AGREE TO PAY full repair costs + $500 per day (or actual lost revenue, whichever greater) for downtime. We photograph the trailer before/after.

3. Customer Assistance, Helpers & Machinery Waiver

CUSTOMER LOADING & MACHINERY RELEASE – READ CAREFULLY

IF YOU, YOUR HELPERS, FAMILY, FRIENDS, EMPLOYEES, CONTRACTORS, OR ANY THIRD PARTY (OR THEIR MACHINERY) ASSIST WITH LOADING, YOU DO SO AT YOUR OWN RISK.

YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Dump It LLC / Dump It KC, its owners, employees, agents, and insurers from ANY AND ALL liability, claims, demands, injuries, death, property damage, or losses arising from such assistance, INCLUDING BUT NOT LIMITED TO NEGLIGENCE (to the maximum extent permitted by Missouri law).

YOU INDEMNIFY, DEFEND, AND HOLD US HARMLESS from any related claims, lawsuits, damages, fines, costs, or attorney fees.

4. Weight Overage Charges

Base quote includes up to 1,000 lbs. Excess weight (per certified scale ticket at the disposal site or our reasonable good-faith estimate if a scale ticket is unavailable) incurs a $100 flat overage fee (any amount over). You may request to view the scale ticket if available.

5. Cancellation, No-Show & Onsite / Refusal Fees

• 48+ hours notice before scheduled arrival: Full deposit refund
• 24–48 hours notice: 50% of quoted fee
• Less than 24 hours, same-day cancellation, or no-show: 100% of quoted fee or $250 trip charge (whichever greater)

Onsite / Refusal Fee – $75 applies if:

• You cancel or decline the job/quote after crew arrival
• We arrive but cannot complete/refuse the job due to safety hazards, inaccessible site, prohibited/hazardous materials, unsuitable conditions (e.g., blocked access, structural risks, unsafe loading environment), or any other valid reason beyond our control

This fee covers dispatch, travel, time, and opportunity costs. If any items are loaded before refusal, additional charges may apply.

6. Site Access & Property Damage Release

You grant safe/legal access and confirm the site/driveway/lawn/path is suitable for a loaded trailer.

YOU RELEASE US FROM LIABILITY for damage to landscaping, pavers, concrete, utilities, or structures from normal operations (unless our gross negligence). We are not liable for weight-related damage.

7. Hazardous & Prohibited Materials

YOU WARRANT no unapproved hazardous/prohibited items (asbestos, chemicals, paint, batteries, tires, propane, Freon appliances, medical waste, etc.). Pre-approval required for exceptions (extra fees).

We reserve the right to inspect loads and refuse any materials suspected to be hazardous. YOU ARE SOLELY RESPONSIBLE for fines, cleanup, surcharges. We may refuse and charge the $75 onsite/refusal fee (or higher applicable fee).

8. Items & Valuation

Items loaded become abandoned/our property. We are not responsible for lost, damaged, stolen, or valuable items. You confirm valuables/sentimental items removed.

9. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS Dump It LLC / Dump It KC, its owners, employees, and insurers from claims, damages, fines, or lawsuits arising from your items, site, actions, helpers, or conditions.

10. Payment, Other Terms, Force Majeure & Dispute Resolution

Payment due on completion (cash, card, etc.). Late fees: 1.5% per month + collection costs. This Agreement is governed by the laws of the State of Missouri, without regard to conflict of laws principles.

Force Majeure: We are not liable for delays, cancellations, or non-performance caused by events beyond our reasonable control, including but not limited to severe weather, natural disasters, traffic/road closures, landfill or disposal site issues, government restrictions, strikes, equipment failure, or supply shortages. In such cases, we will reschedule at no additional charge or refund deposits if the job cannot be completed.

Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to this Agreement, including the breach, termination, enforcement, interpretation, or validity thereof, shall first be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Jackson County, Missouri, and judgment on the award rendered may be entered in any court having jurisdiction. The parties waive any right to a jury trial. The prevailing party in any arbitration or subsequent litigation to enforce an arbitration award is entitled to recover reasonable attorney fees and costs. Venue for any court action to enforce or confirm an arbitration award shall be exclusively in Jackson County, Missouri.

11. Company Insurance

Dump It KC maintains commercial general liability insurance and automobile liability insurance (including trailer coverage) as appropriate for our operations. Certificates of insurance are available upon request. However, our insurance does not cover customer-provided items, site conditions, or losses arising from customer negligence or prohibited items. We do not maintain workers' compensation insurance at this time. We are not responsible for pre-existing damage or conditions at the site.

Severability & Entire Agreement

Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether written or oral. No modifications are valid unless in writing and signed by both parties.

Electronic Agreement Confirmation

By checking the agreement box and submitting your booking (or electronically signing via our form), you ("Customer") confirm you are 18+ years old, authorized to agree, and agree to conduct this transaction electronically under Missouri law. You acknowledge reading, understanding, and accepting all terms above. This is a binding contract—no verbal changes. You also agree to our Privacy Policy (available at dumpitkc.com/legal/privacy-policy), which governs how we collect, use, and protect your personal information.
